Services to the Insurance Industry

We assist our clients in developing practical, innovative and cost-effective steps to expanding and improving their operations, while accommodating regulators. At times this requires working with regulators to develop new approaches recognizing changes in the market. “Never been done before” doesn’t mean “cannot be done”.

  • Admissions and Re-domestications – whether seeking authority to write in a particular state, or moving a company’s domicile, we can assist in developing the proposal, executing the paperwork, satisfying the regulators’ due diligence, and representing your group in public hearings.
  • Acquisitions – we offer experience and proven success in guiding insurers and holding companies through the highly technical process of gaining approval to acquire an insurer or related entity.
  • Formation and Approval – from the moment you decide to form an insurance related entity, whether an authorized insurer, a self-insurance group, or a self-insured plan, we can assist you in formation of your entity while anticipating regulators’ concerns and ensuring approval without unnecessary delays.
  • Legislative Drafting and Lobbying – we offer vast experience in drafting insurance-related legislation, testifying on behalf of legislation, and guiding legislation through the process to passage and promulgation. Our experience includes working with all of the national insurance industry groups to reach consensus whenever possible.
  • Form Filings, Rate Filings and Advertising Filings – we can save you valuable time and effort in assisting you in properly preparing filings, and working closely with regulators to move your filings through the process.
  • Exclusions and Form Amendments – many exclusions and amendments require extensive language negotiation with regulators, such as adding a mold exclusion to a homeowners policy, and we are experienced in successfully conducting those negotiations.
  • Multiple Employer Welfare Arrangements – whether you need help in extricating yourself from an improper MEWA, or in forming a MEWA that will comply with state and federal law, our experience will prove crucial to your success.
  • Reinsurance and Stop-Loss Review – we offer experience in reviewing reinsurance and stop-loss agreements for regulatory approval, as well as negotiating favorable agreements for insurers.
  • Negotiation with Regulators – whether challenging examination findings, defending against a complaint, or proposing a new product, there are times when you need someone to intercede with regulators on your behalf, and our track record on such negotiations is excellent.

Services to Receivers and Attorneys

Receivers must effectively deal with every facet of the company they are administering, and having a “fresh pair of eyes” look at a particular problem can save time for the receiver and money for the estate. Attorneys litigating insurance matters often need expert help in deciphering policy language and industry standards. We offer cost-effective professional assistance.

  • Expert Reports – whether disputing coverage itself, the details of coverage, or the quantum involved, the technical provisions of insurance policies can seem like a maze. Our experience in providing clear and concise expert reports to active and potential plaintiffs and defendants has proven crucial to receivers and attorneys.
  • Expert Testimony – having an expert who is comfortable with, and can withstand, cross-examination is an invaluable weapon in litigation, and our track record is stellar.
  • Litigation Support – litigation tactics may preclude the desire for an expert report that is discoverable, but we can offer you in-house analysis of insurance issues to move you forward on the right path.
  • Fraud Investigations – many receivers and attorneys make the mistake of thinking that all insurance fraud can be detected by accountants, but the numbers are often not the whole story. We offer significant and proven experience in investigating fraud, both by and against insurers.
  • Regulatory Compliance Review – regulatory compliance matters often involve a combination of legal issues, business decisions, market factors, and current regulatory climate. We can often provide value by assisting in the preparation of your documents before submission.
  • Technical Support - while you may do an excellent job of representing an insurer on general legal issues, specific regulatory issues can be highly technical and/or obscure. We can assist you in keeping your client satisfied and burnishing your reputation.
  • Legislative Drafting and Lobbying – when your client wants to address a problem through legislation, but legislative work is not your forte, we offer vast experience in drafting insurance-related legislation, testifying on behalf of legislation, and guiding legislation through the process.

Services to Regulators

Both state and federal regulators are frequently understaffed and faced with monumental workloads, leaving little time for analyzing outdated methodologies and improving efficiency and effectiveness. Achieving the delicate balance of appropriate regulation without impeding or damaging a healthy market requires constant reassessment.

  • Investigation – we offer broad experience in investigation on behalf of regulators, including fraud investigations relative to both active companies and companies in receivership, targeted market conduct examinations, MEWA investigations, and fraudulent asset investigations
  • Training – a variety of training options are available, from hands-on training of regulators on an array of subjects such as policy form review, complaint investigation and consumer outreach, to staff seminars on specialized topics such as Multiple Employer Welfare Arrangements.
  • Procedure Review and Analysis – we offer review and analysis of internal procedures, which without ongoing evaluation can become stagnant, unwieldy and counterproductive. Particular emphasis is placed on increasing communication, coordination and cross-training between the various divisions within the agency.
